Bail is a promise by a person
accused of a criminal offense they will appear in court
as
ordered. A person may deposit
a cash bond with the court, and at the conclusion of the
criminal proceeding, will receive that amount back if they
have appeared as ordered throughout the process. If the
person does not have the financial resources to deposit
the full amount of the bail, they may contract with a bonding
company. In this case, the person will
pay a non-refundable fee to
the bonding company, and the bonding company will make a
promise to the court ensuring the person’s appearance as
ordered.
Although, bail is not intended as punishment, a person may
not have sufficient financial resources to post their bail
amount and may not be able to afford the services of the
bonding company. There are many factors in determining an
appropriate bail amount for each person, there is not one
rule that fits everybody. An experienced attorney can present
the individual factors in requesting a reasonable bail that
ensures the person’s appearance without creating
an undue financial burden on
family and friends.
